Terms and Conditions

  1. DEFINITIONS

 

  1. The words below, when used in these terms and conditions, shall have the meaning given here: 

 

  • Associated Cost(s)” shall have the meaning at 7.3;

 

  • Cash Alternative” means the amount of the money a Winner can choose to receive instead of a Property;

 

  • Closing Date” means the time and date when a Competition will close;

 

  • Competition” shall have the meaning at 2.2;

 

  • Competition Page” shall have the meaning at 3.1;

 

  • Draw Date” means the date when the Winner of a Competition will be drawn in accordance with clause 6.1.3 and 6.1.4;

 

  • Entry” shall mean an entry to a Competition;

 

  • Expert” shall have the meaning at 6.1.1;

 

  • Maximum Entries” means the total number of Entries which are available for a Competition;

 

  • Opening Date” means the time and date when a Competition will open;

 

  • Options” shall have the meaning at 5.2.2.2;

 

  • Owner” shall have the meaning at 7.8.2;

 

  • Prize” shall have the meaning at 7.1;

 

  • Promoter” shall have the meaning at 2.1;

 

  • Property” means the property which may be won in the respective Competition;

 

  • Time Period” shall have the meaning at 5.2.2.3;

 

  • Transfer Date” means the date when a Property is transferred to a Winner;

 

  • Valuation” means the estimated value of a Property, as estimated by the Promoter;

 

  • Winner” shall mean the winner of a Competition;

 

 

 

 

  1. THE PROMOTER

 

  1. The Promoter is: HOUSEAGOGO LIMITED a company registered in England and Wales with company number 10809859 whose registered address is at 19 Cypress Road, London, United Kingdom, SE25 4AY.

 

  1. The Promoter will operate skill based competitions (each referred to as a “Competition”) which can be entered into on the Website, which will result in the allocation of a Prize in accordance with these terms and conditions.

 

  1. A COMPETITION  

 

  1. Each Competition will have a separate webpage on the Website (a “Competition Page”).

 

  1. Each Competition Page will detail, for the respective Competition, the:
    1. Property;
    2. Valuation;
    3. Cash Alternative
    4. Maximum Entries;
    5. Opening Date;
    6. Closing Date (though this may be brought forward in accordance with clause 3.4); and
    7. Draw Date.

 

  1. A Competition will be open from the respective Opening Date to the Closing Date.

 

  1. If the Maximum Entries are purchased:
    1. the Closing Date will be brought forward to the time and date when the final Entry was purchased; and
    2. the Draw Date will be brought forward to a date within [30 ] days of when the final Entry was purchased and the revised Draw Date will be published on the Website.

 

  1. ELIGIBILITY

 

  1. A Competition is open to residents in Great Britain aged 18 years or over, except:
    1. employees of the Promoter or its holding or subsidiary companies;
    2. employees of agents or suppliers of the Promoter or their holding or subsidiary companies, who are professionally connected with a Competition or its administration;
    3. professional advisers or anyone else connected with de development or operation of the Website or Competition in any way;
    4. the Expert; or
    5. members of the immediate families or households of 4.1.1 to 4.1.4.

 

  1. A person entering a Competition is required to provide their name, age, home address, email address and contact number to the Promoter.

 

  1. By entering a Competition, you confirm that you are eligible to do so and eligible to claim any Prize you may win. The Promoter may require you to provide proof that you are eligible to enter a Competition.

 

  1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to refuse or disqualify any Entry.

 

  1. Only a natural person, as opposed to any association such as a limited company or partnership, may enter a Competition.

        

  1. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit of a Competition.

 

  1. HOW TO ENTER

 

  1. To enter a Competition, you will need to first register an account with us.  You can register an account online at the Website by providing an email address or signing in via a social media account such as Facebook or Twiter.  A person may only open one Account on the Website.

 

  1. To enter a Competition, you must create an online account and submit an Entry to the Promoter.  To submit an Entry, you must:
    1. select the Competition you wish to enter and then purchase your Entry or Entries, together with providing your contact and payment details. You will need to check your details carefully and tick the declaration , confirming you have read and understood the Competition terms and conditions;
    2. once you have purchased your Entry/Entries, participate in the Competition as below:
      1.       you will be provided with a picture of a property;
      2.       you must estimate the age of the property by selecting, from pre-defined options (the “Options”), the age which you consider to be closest to the actual age of the house;
      3.       you must make your selection from the Options within 60 seconds (the “Time Period”),
    3. when your payment for your Entry/Entries has cleared the Promoter will contact you by email to confirm your entry into the Competition. 

 

  1. You will only be deemed to have entered a Competition once the Promoter has emailed you to confirm your Entry/Entries.  The Promoter will not accept: (a) responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or (b) proof of transmission as proof of receipt of entry to a Competition.

 

  1. If you do not select an Entry within the Time Period, the Entry will be marked as having made no selection for the age of the Property, but will be entered into the Competition.  For the avoidance of doubt, such an Entry could not result in you winning a Competition, as you will have made no selection for the age of the Property.  However, such an Entry would qualify for a refund, if the Promoter elects to refund all Entries in accordance with clause 9.1. 

 

  1. If you purchase more than one Entry for a Competition, each Entry must be purchased at the same time and for the same Option.

 

  1. An Entry must be received by the Promoter by no later than the Closing Date. An Entry received after the Closing Date will be automatically disqualified

  

  1. Entries on behalf of another person are not permitted and joint submissions are not permitted.

 

  1. By submitting an Entry, you agree to be bound by these terms and conditions and warrant that all information provided to the Promoter is accurate, true, current and complete.

 

  1. SELECTION OF WINNER

 

  1. A Winner will be selected by the following process:
    1. within 10 days of the Closing Date, the Promoter will appoint a judge with property expertise (the “Expert”) to select which of the Options they consider to be closest to the age of the Property;
    2. after the Expert has a selected an Option, each of the Entries which selected that Option will be entered into a draw;
    3. a draw will be made by a computer process; and
    4. the person whose Entry is drawn first will be the Winner.

 

  1. The decision of the Expert is final and no correspondence or discussion will be entered into.

 

  1. The Promoter will send the name of the Expert to anyone who, within one month after the Draw Date, writes to the Promoter at the address set out in clause 2.1 requesting details of the Expert and enclosing a self-addressed stamped envelope.

 

  1. THE PRIZE

 

  1. Subject to clause 7.8, the Winner can elect to receive either:
    1. the Property and Associated Costs; or
    2. the Cash Alternative

each of the options listed at 7.1.1 and 7.1.2 shall be deemed to be a “Prize”.

 

  1. If the Winner elects to receive the Property, the Promoter will be responsible for paying for the following amounts :
    1. stamp duty for the transfer of the Property from the Owner to the Winner;
    2. council tax for the Property for 6 months from the Transfer Date, which the Promoter shall arrange and pay directly to the relevant council;
    3. reasonable conveyancing costs of a solicitor who will act on your behalf and who will be selected by the Promoter, in respect of the transfer of the Property from the Owner to the Winner ;
    4. reasonable building and contents insurance for the Property for 6 months from the Transfer Date, which the Promoter shall arrange and pay directly to the relevant insurer.

 

  1. The costs referred to at 7.2.1 - 7.2.4 are each an “Associated Cost” and are referred to together as the “Associated Costs”.

 

  1. Any other costs incurred in addition to those set out above at 7.2 and that are incidental to the transfer or ownership of the Property are the responsibility of the Winner.

 

  1. The solicitor whose costs will be paid for by the Promoter, as referred to above at 7.2.3, shall be selected by the Promoter but the Winner must sign up with such solicitor as a client, including the provision of any ‘know your client’ documents. 

 

  1. The Winner may elect to use an alternative solicitor, other than the solicitor selected by the Promoter.  In such event, the Winner shall be directly liable for the costs of such solicitor.

 

  1. The Property is supplied by the owner of the Property (the “Owner”).

 

  1. The Promoter reserves the right to substitute the Prize of the Property with:
    1. a monetary payment equal to the aggregate of the Valuation plus an estimated amount of the respective Associated Costs; or 
    2. an alternative property of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so, including if the Owner refuses to transfer the Property to the Winner.

 

  1. The Prize is not negotiable or transferable.

      1. If the requisite number of tickets are not met within the time period set out then the promoter will offer a monetary prize with amount accrued in tickets       sales thus far less administration costs. 

  1. The Promoter makes no representations or warranties in relation to a Property, including its quality/suitability, its structural or cosmetic condition or its ability to be sold.  The Promoter is not liable in any way for the Valuation and makes no representation or warranty in respect of its accuracy 

 

  1. CLAIMING THE PRIZE

 

  1. The Promoter will make reasonable efforts to contact the Winner as soon as practicable after the Draw Date, using the telephone number or email address provided with an Entry.  You are responsible for ensuring the contact details you provide are correct and updating them if necessary

 

  1. If you are a Winner, you will have 20 days from the Draw Date to claim the Prize by sending an email to.

 

  1. If the Winner has not claimed their Prize within 20 days of the Draw Date (which may be extended at the sole discretion of the Promoter), the Winner will forfeit the Prize and the Promoter will repeat the process at 6.1.3 and 6.1.4 with the other eligible Entries which selected the correct Option, and then award the Prize to the person whose Entry which is drawn first (the “Alternate Winner”).  For the avoidance of doubt, once the Prize has been forfeited, the original Winner will have no claim against the Promoter.  The Alternate Winner will have 10 days from the date of the re-arranged draw to claim the Prize.

 

  1. Before any Prize will be paid or transferred, the Promoter reserves the right to require a Winner to:
    1. provide a certified copy of their passport or driving licence to the Promoter to confirm their identity, age; and
    2. if the purchase of the Entry was made by debit card or credit card, prove that that the card was legally theirs or that they had authorisation to use it.

 

  1. If a person fails to meet the obligations listed at 8.4.1 or 8.4.2, the Promoter reserves the right to disqualify the Winer and choose an alternate Winner.

 

  1. Following receipt and verification of the details requested above by the Promoter, the Winner will be contacted in order to make arrangements for transfer of the Prize. At this point the Winner must choose between the Property and Cash Alternative.

 

  1. A Prize may not be claimed by a third party on behalf of a Winner.

 

  1. The Promoter does not accept any responsibility if a Winner is not able to receive a Prize for any reasons outside of the Promoter’s control.

 

  1. The Promoter reserves the right to refuse or disqualify any incomplete Entry if it has reasonable grounds for believing that an Entry has breached any of these terms and conditions.

 

  1. The Promoter shall use its best endeavours to award the Prize for a Competition to the correct Entry. If due to reasons of hardware, software or other computer related failure, or due to human error the Prize is awarded incorrectly, the Promoter reserves the right to reclaim a Prize and award it to the correct Entry, at its sole discretion and without admission of liability. 

 

  1. If a Winner chooses to receive the Property, they must comply with all reasonable requests of the Promoter with regards to the transfer of the Property, including the execution of any document, including a transfer deed.  The Property will be transferred to the Winner in accordance with a reasonable timeframe for such process.

 

  1. The Promoter will send you the name and county of a Winner if, within one month after the Draw Date, you write to the Promoter at the address set out in clause 2.1 requesting details of the Expert and enclosing a self-addressed stamped envelope.   By entering a Competition, you consent to your name being provided in accordance with this clause if you are a Winner.

 

  1. ENTRY REFUNDS

 

  1. Subject to clause 9.2, the Promoter will refund the cost of each Entry to the Competition if, with regards to the respective Competition:
    1. the Owner removes the Property from a Competition; or
    2. the Promoter chooses to close a Competition for any other reason at its absolute discretion.

 

  1. If any of the events at 9.1.1 - 9.1.3 occur, the Promoter reserves the right, as an alternative to refunding the cost of an Entry, to either:
    1. substitute the Prize of the Property with a monetary payment equal to the aggregate of the Valuation plus an estimated amount of the respective Associated Costs; or
    2. replace the Property with an alternative property of equal or higher value (at the Promoter’s sole discretion) if circumstances beyond the Promoter’s control makes it necessary to do so, including if the Owner refuses to transfer the Property to the Winner.

 

  1. Any refund will be repaid to the same debit or credit card  from which the original payment was received.

 

  1. Where the fee for an Entry is returned, the Promoter shall have no further liability to you.

 

  1. LIMITATION OF LIABILITY

 

  1. Nothing in these terms shall limit or exclude our liability for death or personal injury caused by the Promoter’s negligence or any matter in respect of which it would be unlawful for us to exclude or restrict liability.

 

  1. Subject to 10.1, and insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to a Winner, or any other person, or accept any liability for any loss (including consequential loss), damage, personal injury or death which results from a person receiving a Prize or otherwise results from any Competition.

 

  1. If due to reasons of hardware, software or other computer related failure, or due to human error a Prize is awarded incorrectly, the Promoter reserves the right to reclaim the Prize and award it to a person who should have been awarded the Prize, at its sole discretion and without admission of liability.  The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom a Prize has been incorrectly awarded, and no compensation shall be due. 

 

  1. PUBLICITY

 

  1. If you are the Winner of a Competition, you agree that the Promoter may use your name, image and town or county to announce the Winner of a Competition and for any other reasonable and related promotional purposes. 

 

  1. You further agree to participate in any reasonable publicity required by the Promoter.

 

  1. DATA PROTECTION

 

  1. By entering a Competition, you agree that any personal information provided by you to the Promoter or an agent of the Promoter may be held and used by the Promoter or its agents to administer a Competition and provide Prizes where applicable .

 

  1. GENERAL

 

  1. The Promoter reserves the right to hold void, suspend, cancel, or amend a Competition where it becomes necessary to do so.

These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales
